Terms and Condition

1. Introduction

These Terms and Conditions Agreement govern your use of the fleet tracking services provided by Tracking.me Company, we, us, or our in the Kingdom of Saudi Arabia. By accessing or using our services, you Client, you, or your agree to be legally bound by this Agreement.

2. Compliance with Saudi Law

Tracking.me is fully compliant with the laws and regulations of the Kingdom of Saudi Arabia, including but not limited to:

• Communications and Information Technology Law
• Electronic Transactions Law
• Cybersecurity Framework
• Transport General Authority regulations for fleet monitoring and safety
• Personal Data Protection Law (PDPL), Royal Decree No. M/19 of 17/09/1443H

3. Services Provided

Tracking.me provides:

• GPS-based fleet tracking and vehicle telematics
• Real-time location data and movement history
• Driver behavior monitoring
• Reporting and analytics dashboards
• Integration with transport authorities where required (e.g., TGA, Public Transport Authority)

4. Account Registration

To access our services, the Client must:

• Be legally registered in Saudi Arabia with a valid CR
• Provide accurate company and vehicle data
• Designate authorized users responsible for system access

5. Client Responsibilities

The Client shall:

• Use the service only for lawful fleet management purposes
• Ensure that their drivers and fleet are informed of the use of tracking systems
• Not tamper with, disable, or misuse the tracking hardware or software
• Be responsible for data shared from their account

6. Data Protection and Privacy

• All data collected, including GPS logs and driver behavior, is handled in compliance with the Saudi Personal Data Protection Law (PDPL).
• We will not share Client data with third parties without explicit consent, except when required by regulatory authorities
• Clients are responsible for ensuring their use of employee/fleet tracking complies with the labor and privacy laws of Saudi Arabia.

7. Hardware and Installation

• Devices are either sold or leased as per the service agreement.
• Installation shall be performed by approved technicians or as otherwise agreed.
• Tampering or unauthorized removal of devices may result in service suspension.

8. Service Fees and Payment Terms

• Fees are as agreed in the signed contract or published pricing model.
• Invoices must be paid within 30 days of issuance unless otherwise agreed.
• Delayed payments may result in service suspension and/or penalties.

9. Service Availability and Limitations

• While we strive for 99.9% uptime, the service may be temporarily unavailable for maintenance or due to force majeure events.
• Tracking.me is not liable for any business losses due to service interruptions.

10. Termination

Tracking.me may suspend or terminate service:

• For breach of these terms
• Upon failure to pay due fees
• If required by legal or regulatory authorities

Clients may terminate with 30 days’ written notice, subject to the agreed minimum contract period.

11. Limitation of Liability

• Tracking.me shall not be liable for any indirect, incidental, or consequential damages.
• Total liability shall not exceed the amount paid by the Client in the 3 months preceding the claim.

12. Intellectual Property

• All software, reports, and platform content remain the intellectual property of Tracking.me.
• Clients are granted a non-exclusive, non-transferable right to use the services during the subscription term.

13. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Kingdom of Saudi Arabia. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, unless otherwise specified in a written agreement.

14. Amendments

Tracking.me reserves the right to amend these Terms and Conditions. Clients will be notified at least 15 days prior to the effective date of any material changes.
